Terms and Conditions
Introduction
Please read all the items in these terms and conditions before agreeing to them. By agreeing to these terms, you are bound by them on behalf of any affiliated companies or organizations.
1. Definitions and Interpretation
1.1. "This Site" refers to KatsuWin.
1.2. "KatsuWin" refers to KatsuWin.
1.3. "Company" refers to Initial Singularity Limited.
1.4. "Affiliate Program" refers to the partnership between this Site and its partners. Partners promote KatsuWin and are expected to continuously generate new players for this Site.
1.5. "Affiliate Partner" or "Partner" refers to an individual who registers and participates in the Affiliate Program of this Site.
1.6. "Affiliate Partner Website" refers to https://katsuwinaffiliates.ai/, which is maintained and operated by the Partner as a platform (website/application/widget, etc.) to provide affiliate links and codes for this Site.
1.7. "Affiliate Link" refers to a unique affiliate-specific customer referral link used by Affiliate Partners during promotions. Players can register via this link to become members of the affiliate program.
1.8. "Affiliate Code" refers to a code assigned to each Partner. When this code is entered during registration, the player is registered as a sub-member of the respective Partner.
1.9. "Player" refers to an individual who creates a gaming account with KatsuWin.
1.10. "Affiliate Account" refers to the account issued to affiliates upon registering for the affiliate program at https://katsuwinaffiliates.ai/.
1.11. "Sub-Member" refers to a Player who has completed registration with KatsuWin through an affiliate link or referral code.
1.12. "This Website" refers to https://katsuwinaffiliates.ai/.
1.13. "Commission" refers to the rewards provided to Affiliate Partners by this Site upon meeting the conditions outlined in the affiliate plan.
2. Affiliate Partner Eligibility Conditions
2.1. The Affiliate Partner represents and warrants the following:
a. The Affiliate Partner has the right and authority to enter into the partnership agreement and fulfill all obligations under it.
b. The Affiliate Partner has obtained and will maintain all necessary registrations, permissions, consents, and licenses required to fulfill the obligations under the partnership agreement.
c. The Affiliate Partner fully understands and agrees to the terms of the partnership agreement.
3. Rights and Obligations of the Company
3.1. The Company reserves the right to accept or decline new Partners at its discretion. Submitted Partner information will be reviewed, and the results will be notified via email.
3.2. The Company will record the total amount of commissions and provide Affiliate Partners with access to their total commissions and statistical data via the Affiliate Partner Website.
3.3. The Company will pay commissions to Affiliate Partners in accordance with these terms and conditions.
3.4. The Company reserves the right to terminate, modify, or close the Affiliate Program and to amend the provisions of these terms and conditions at its discretion.
3.5. Changes to the Affiliate Program or Affiliate Account status will be communicated to Affiliate Partners via email.
3.6. The Company reserves the right to make final decisions, including account closure, if the following conditions are not met:
a. Compliance with domestic and international regulations.
b. Adherence to the Company’s policies.
c. Protection of the interests of the Company, Players, Sub-Members, or other third-party institutions.
3.7. The Company will use and process Partner personal information for purposes such as high-level security, compliance with anti-money laundering legal requirements, and management of the business relationship, in accordance with the privacy policy.
This includes:
a. Name
b. Date of birth
c. Country of residence and address
d. Email address and phone number
e. Account information
4. Rights and Obligations of Affiliate Partners
4.1. Affiliate Partners guarantee and agree to the following:
a. They will engage in marketing and promotion of this Site at their own expense to maximize benefits for both the Site and themselves.
b. They will use the affiliate links, affiliate codes, promotions, and marketing tools provided within the scope of the Affiliate Program.
c. Their marketing activities will be conducted appropriately and professionally in compliance with these terms and conditions.
d. They will always comply with applicable laws and regulations related to data protection and privacy.
e. They will maintain and update all media (websites, banner ads, links, newsletters, etc.) used to promote the Site, ensuring that promotional materials are updated as the Site’s information changes.
f. If misleading content is included on the Partner’s website that causes liabilities or disadvantages to the Site, the Partner will bear responsibility.
g. Marketing activities will be conducted in a manner favorable to the Site.
h. They will not engage in discriminatory, obscene, illegal, sexually explicit, pornographic, violent, or fraudulent marketing activities (including on Partner websites).
i. They will not target individuals below the legal gambling age.
j. They will not target jurisdictions where gambling or gambling promotion is illegal.
k. They will not use representations, trademarks, or intellectual property of the Company or KatsuWin without prior approval, except for marketing tools provided by this Site.
l. They will maintain the confidentiality of login information provided by the Company.
m. They will be solely responsible for any unauthorized use of login information resulting from their failure to adequately protect it.
n. They will be solely responsible for all activities and actions associated with their Affiliate Account user ID and password.
o. They will immediately notify the Company in case of suspected illegal or unauthorized use of their credentials.
4.2. If the Company determines that Sub-Member registrations, referrals, or bets were made through fraudulent methods or in violation of these terms, it reserves the right to freeze the Affiliate Account and deduct commissions.
5. Commission
5.1. The Company will pay commissions to Partners in accordance with these terms and conditions. Our company adopts the "NNCO (No Negative Carryover)" policy. This means that any negative balance at the end of each month will be reset and will not be carried over to the following month.
a. ¥0–¥500,000: 20%
b. ¥500,000–¥1,000,000: 25%
c. ¥1,000,000–¥1,500,000: 30%
d. ¥1,500,000–¥2,000,000: 35%
e. ¥2,000,000+: 40%
5.1.1. The conditions for generating affiliate commissions are as follows:
5.1.2. Definition of Active Player:
An Active Player is defined as a player who has participated at least once within the specified period. Specific activity criteria include playing games, making deposits, or other specified actions.
5.1.3. Conditions for Generating Commissions:
In order for affiliates to receive commissions, they must acquire a minimum of 5 Active Players. Affiliate commissions will only be generated if this condition is met.
5.2. Commission calculation formula:
Total Revenue (Bet Amount - Winnings) - Total Costs (Bonuses/Deductions + Adjustments - Other Costs) x Commission Rate
5.3. Commissions are finalized at the end of each month and calculated by the 5th of the following month.
5.4. After calculation, Partners must submit withdrawal requests via the Site.
5.5. Requested amounts will be deposited into registered payment accounts starting from the 15th of each month.
5.6. Payments falling on Japanese holidays will be postponed to the next business day.
5.7. Payments are delayed until payment methods are registered.
5.8. The Company reserves the right to change payment dates with prior notice.
5.9. Negative carryover is not applied; negative commissions reset at the start of the following month.
5.10. The minimum commission withdrawal amount is ¥30,000. Withdrawals cannot be requested for balances below this amount.
5.11. Deductions may include:
a. Bonus costs
b. Game platform costs
c. Jackpot costs
d. Payment costs
5.12. Partners must refund commissions received based on fraudulent or incorrect transactions.
5.13. The Company has final decision rights regarding all commission-related matters.
6. Prohibited Activities
6.1. If prohibited activities are discovered, all related commissions will be forfeited, and the Affiliate Account will be frozen. Examples include:
a. The Affiliate Partner and Sub-Member using the same account (same IP address, name, etc.).
b. Self-affiliation by the Affiliate Partner.
c. Registering existing players through their own affiliate link or code.
d. Becoming a Sub-Member of another Affiliate Partner.
e. Collusion between Affiliate Partners to earn commissions.
f. Collusion between Affiliate Partners and Sub-Members or Players to earn commissions.
g. Fraudulent acts to increase commissions, such as registering oneself or third parties as players for personal use.
h. Disclosing information obtained from the Site to third parties.
7. Liabilities and Limitations
7.1. The Company is not liable for:
a. Economic losses (including profits, revenue, business, or contracts).
b. Loss of reputation or goodwill of the Affiliate Partner or their website.
c. Intentional, incidental, indirect, or consequential losses.
7.2. Partners must indemnify the Company for any losses, damages, or liabilities arising from their violations of these terms.
8. Confidential Information
8.1. All information is confidential and cannot be used for personal or commercial purposes without prior written consent from the Company.
8.2. Partners may not use confidential information for purposes other than fulfilling their obligations under these terms.
8.3. This clause survives termination of the partnership agreement.
9. Termination of Agreement
9.1. Either party may terminate the agreement by email notification. If the Site ceases its services, the agreement will automatically terminate.
9.2. Serious breaches of these terms allow either party to terminate the agreement immediately.
9.3. If the Partner fails to actively promote the Site, the Company may terminate the agreement and freeze the Affiliate Account.
10. Amendments to Terms and Conditions
10.1. The Company reserves the right to amend, modify, or delete these terms at any time without prior notice. Continued participation in the Affiliate Program implies acceptance of the updated terms.
11. Governing Law
11.1. These terms are governed by the laws of Anjouan. Disputes must be resolved under the exclusive jurisdiction of Anjouan law.
